{"id":7088,"date":"2024-09-26T13:36:27","date_gmt":"2024-09-26T01:36:27","guid":{"rendered":"https:\/\/www.jamesandwells.com\/best-method-requirement-in-australian-and-new-zealand-patent-law\/"},"modified":"2024-09-26T13:36:27","modified_gmt":"2024-09-26T01:36:27","slug":"best-method-requirement-in-australian-and-new-zealand-patent-law","status":"publish","type":"post","link":"https:\/\/www.jamesandwells.com\/au\/best-method-requirement-in-australian-and-new-zealand-patent-law\/","title":{"rendered":"Best method requirement in Australian and New Zealand Patent Law"},"content":{"rendered":"<p>A recent decision of Justice Burley in the Federal Court of Australia<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> has shone a light on the requirement of a patentee to disclose the best method of implementing his\/her\/its invention.<\/p>\n<p>In Australia<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a>, as in New Zealand<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a>, it is a requirement for the valid grant of patent rights that the patentee discloses \u201c<em>the best method known to the applicant of performing the invention<\/em>\u201d.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n<p>The philosophical basis for a statutory requirement to disclose the\u00a0best\u00a0method\u00a0was discussed in <em>Les Laboratories Servier v Apotex Pty Ltd<\/em>\u00a0<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> where the Full Federal Court stated that the \u201cbest\u00a0method\u201d requirement puts an obligation on an inventor to disclose a\u00a0method\u00a0which \u201c<em>at the time of filing the complete patent application<\/em>\u201d has \u201c<em>taken the methodology to a more satisfactory stage or provides more certainty so that the public may more quickly and easily utilise the invention for which a monopoly is granted<\/em>\u201d.<\/p>\n<p>Thus, the\u00a0best\u00a0method\u00a0requirement imports obligations of good faith on the applicant to fulfill his or her side of the social contract which underlies the grant of monopoly rights in return for disclosing the invention to the public and increasing the pool of public knowledge. An applicant should not get the benefit of that monopoly without giving the public the consideration of the\u00a0best\u00a0method\u00a0of performing the invention.<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/p>\n<p>However, there is no requirement for the specification to include the superlative \u201cbest\u00a0method\u201d. It is sufficient that the applicant has included the\u00a0best\u00a0method\u00a0of working the invention known to him or her at the relevant time. The best\u00a0method\u00a0of performance also need not necessarily be a specific example of the invention<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a>. Where there are sufficient instructions for the skilled worker to put the claimed invention into effect, the\u00a0best\u00a0method\u00a0requirement will generally be met.<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a><\/p>\n<p>IP Australia\u2019s Patent Examiner\u2019s Manual confirms (at [5.6.7.5]):<\/p>\n<div style=\"margin-left: 40px; margin-right: 40px; margin-bottom: 20px;\"><em><em>\u201c\u2026the description of the method does not need to refer to a specific example (preferred embodiment) of the invention. If there are adequate instructions for the skilled person to put the claimed invention into effect, the best method requirement will generally be met.<\/em><em>\u201d<\/em><\/em><\/div>\n<p>The Manual does however specifically observe the limitations of the examination process in assessing disclosure of the best method:<\/p>\n<div style=\"margin-left: 40px; margin-right: 40px; margin-bottom: 20px;\"><em><em>\u201cThe question of whether the applicant has provided the best method of performing the invention is necessarily one of fact and evidence, with the knowledge of relevant facts inherently lying with the applicant.\u00a0Evidence for whether the applicant has actually provided the best method of performing the invention is generally not available during examination. Therefore, any method the applicant has provided is considered \u2018the best method\u2019. Objections relating to whether it really is the best method are likely to arise during opposition proceedings rather than during examination.\u201d<\/em><\/em><\/div>\n<p>So, acceptance by IP Australia (or, in New Zealand, IPONZ) of satisfaction of the statutory requirement is only prima facie proof that the requirement has actually been met, and is subject to rebuttal by evidence the patentee actually knew of and failed to disclose a better method of putting the claimed invention into practice.<\/p>\n<p>In <em>Les Laboratoires Servier v Apotex Pty Ltd<\/em><a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a>, the Full Federal Court applied a five-stage analysis for determining whether the\u00a0best\u00a0method\u00a0had been disclosed, as follows:<\/p>\n<div style=\"margin-left: 40px; margin-right: 40px; margin-bottom: 20px;\">\n<p>(i) The\u00a0method\u00a0the patentee failed to disclose is a\u00a0method\u00a0of performing the invention;<\/p>\n<p>(ii) The\u00a0method\u00a0is in fact a better\u00a0method\u00a0of performing the invention than the\u00a0method\u00a0disclosed in the specification;<\/p>\n<p>(iii) The\u00a0method\u00a0was known to the patentee at the time of filing;<\/p>\n<p>(iv) The\u00a0method\u00a0is not disclosed in the specification; and<\/p>\n<p>(v) The patentee knew that the\u00a0method\u00a0was better than the\u00a0method\u00a0described in the specification.<\/p>\n<\/div>\n<p>Notably the third and fifth stages of that analysis are subjective enquiries focusing on the patentee\u2019s actual knowledge.<\/p>\n<p>It perhaps should not come as a surprise then that in <em>Pfizer Ireland Pharmaceuticals v Samsung Bioepis AU Pty Ltd (No.4)<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a><\/em>an application for particular discovery for documents held by the patentee going to the issue of best method was granted by Justice Burley.\u00a0 Pfizer\u2019s patent concerns a biological medicine useful in the treatment of autoimmune diseases. Its patent includes 17 examples of which Example 16 is said to be the culmination of research and experiments in Examples 1-15. However, according to Samsung, Example 16 is deficient in a number of ways including that it omits information which may be inferred to have been known to Pfizer at the time of filing the patent application. Discovery was sought to prove whether the omissions from the Example were known to Pfizer.<\/p>\n<p>Pfizer resisted the application as a fishing exercise but also filed evidence from one of the co-inventors to the effect that \u201c<em>Examples 1-17 collectively describe in great detail, how the inventive medium characteristics and culture conditions were developed, what the important variables are and in particular&#8230;which media characteristics are particularly preferable\u2026\u201d<\/em> Justice Burley considered that evidence supported the application since it appeared to his Honour that it confirmed Pfizer agrees Example 16 by itself doesn\u2019t disclose the best method of performing the invention but says that the relevant information can be gleaned from the specification as a whole. Accordingly, discovery was granted.<\/p>\n<p>Pfizer\u2019s defense seems to elide sufficiency with best method. While the\u00a0best\u00a0method\u00a0requirement ostensibly falls under the head of sufficiency, it is in fact an additional obligation on the applicant. Hence, it is possible that an invention could be sufficiently explained in a specification to enable to skilled person to put the invention into effect, yet the specification could still be invalid because the applicant did not disclose the\u00a0best\u00a0method\u00a0for doing so.<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a><\/p>\n<p>In\u00a0<em>Les Laboratoires Servier v Apotex Pty Ltd<\/em>, the Full Federal Court ruled that Les Laboratoires Servier (Servier) had not disclosed the\u00a0best\u00a0method. Servier argued that two alternative\u00a0methods\u00a0it was found as a matter of fact to have devised (but not to have disclosed in the patent) did not constitute a better\u00a0method\u00a0because there was no evidence that the\u00a0method\u00a0disclosed in the specification would have achieved a worse result.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a> The Court acknowledged this but said that what Servier had done was disclose a general methodology, or an \u201cumbrella\u201d\u00a0method, rather than a specific\u00a0method.
