New Zealand punches above its weight in many fields, but few are as exciting or as consequential as aerospace. From the remote coastline of the M\u0101hia Peninsula, rockets now launch to orbit on a near-weekly basis. In Christchurch, engineers are developing fully reusable spaceplanes designed to make access to space routine. In Northland, autonomous aircraft are learning to fly without pilots. Across the country, a growing ecosystem of startups, researchers, and established companies are quietly shaping what the future of flight looks like. This is a sector worth knowing about, and therefore a sector in which new ideas are worth protecting.<\/p>\n
This article is part of a series that James & Wells is publishing on intellectual property (IP) in the New Zealand aerospace sector. So far, we have written about the history of aerospace innovation in New Zealand and the lessons it holds for modern IP strategy<\/a>, compulsory licensing and how governments can access patented technology during national security emergencies<\/a>, and how aerospace companies can get IP investment-ready<\/a>.<\/p>\n This article takes a step back to explain why the aerospace sector matters so much for New Zealand, and why IP sits at the heart of its success.<\/p>\n According to a 2025 report<\/a> commissioned by the Ministry of Business, Innovation and Employment, New Zealand’s space sector contributed NZ$2.47 billion to the economy in the 2023 to 2024 financial year and supports approximately 17,000 jobs. The same report values New Zealand’s advanced aviation sector, covering technologies like electric aircraft and autonomous drones, at a further NZ$500 million and supports approximately 3,700 jobs. Together, these two sectors have grown 53% since 2019, outpacing the broader New Zealand economy. The Government has set a target to double by 2030<\/a>.<\/p>\n These figures may surprise many New Zealanders, who may not immediately associate their country with space and advanced aviation. Yet the sector’s success makes sense when you consider New Zealand’s advantages: a southern-hemisphere launch site with access to sun-synchronous orbits, clear and largely uncontested airspace ideal for flight testing, a pragmatic and responsive regulatory environment, and a culture of ingenuity born from necessity. Rocket Lab, which launched its first Electron rocket from M\u0101hia in 2017 and has since completed dozens of commercial missions, is perhaps the most visible symbol of what New Zealand aerospace can achieve. But it is far from the only one.<\/p>\n Space firms in New Zealand generate 29% of their revenue from overseas customers. They also invest 11% of turnover into research and development<\/a>, which is over seven times the New Zealand average[1]<\/a>. That R&D intensity is a strong signal that this is a sector that runs on ideas, and where the ability to protect, commercialise, and build on those ideas can make or break a company.<\/p>\n The technologies in aerospace are extraordinarily complex, typically requiring years or decades of development before reaching commercial viability. A new aircraft propulsion system may take 10 to 15 years from concept to certification. A launch vehicle may require hundreds of test flights before it is reliable enough to carry commercial payloads. The upfront costs are enormous, the regulatory hurdles are high, and the margin for error is essentially zero.<\/p>\n This creates an unusual commercial environment. Aerospace companies often cannot rely on speed-to-market alone to stay ahead of competitors. By the time a product reaches certification, rivals may have had years to observe your approach and develop their own. This is precisely why IP protection is so important in aerospace, as a well-timed patent can give a company a head start that lasts for years, or even decades, after commercialisation. It transforms the investment in R&D from a sunk cost into a strategic asset.<\/p>\n At the same time, aerospace is inherently global. A New Zealand company launching satellites will deal with launch sites in multiple countries, satellites operating in international airspace and outer space, ground stations on different continents, and customers spread across the globe. Each of those jurisdictions has its own IP rules, and failing to account for them can mean losing protection in the markets that matter most.<\/p>\n IP is a broad term for legal rights that protect creations of the mind. In the aerospace context, the most commonly relevant forms are outlined below.<\/p>\n Patents<\/strong> protect novel and non-obvious inventions that solve technical solutions to problems. A patent gives its owner the exclusive right to use, make, and sell the invention for up to 20 years in the jurisdictions where the patent is granted.<\/p>\n Trade secrets<\/strong> protect confidential information, such as manufacturing processes, software algorithms, or test data, that give a company a competitive edge.<\/p>\n Trade marks<\/strong> protect brand names, logos, and other identifiers that distinguish one company’s products or services from another’s. Well-known examples include SpaceX’s registrations for FALCON and STARLINK; and Rocket Lab’s registrations for ELECTRON and PHOTON, which protect the identity of key technologies.<\/p>\n Copyright<\/strong> protects original creative works, including technical drawings, software code, and reports, and arises automatically upon creation without the need for registration of these rights.<\/p>\n For aerospace companies, IP is not just a legal formality, it is the foundation of commercial value. Strong IP portfolios attract investment, enable licensing deals, support joint ventures, and underpin a company’s valuation at exit. As one Kiwi founder put it<\/a>: “IP is extremely important. It’s literally your foundation \u2014 the concrete of your company<\/em>“. When investors assess an early-stage aerospace company, one of the first questions they ask is what IP the company has and how well it is protected.<\/p>\n IP also provides a mechanism for companies to recoup the enormous investment that aerospace development requires. A patent, in particular, is an agreement between an inventor and the public: the inventor discloses how their invention works (enabling others to learn from it), and in return receives a period of exclusivity during which only they can commercialise it. In an industry where R&D costs can run into the tens of millions, that period of exclusivity can mean the difference between commercial viability and unsustainable losses.<\/p>\n Over the coming months, James & Wells will publish more articles exploring the intersection of IP and aerospace in more depth.
