{"id":3871,"date":"2022-02-24T15:14:23","date_gmt":"2022-02-24T02:14:23","guid":{"rendered":"https:\/\/www.jamesandwells.com\/enforcing-rights-in-unregistered-trade-marks\/"},"modified":"2022-02-24T15:14:23","modified_gmt":"2022-02-24T02:14:23","slug":"enforcing-rights-in-unregistered-trade-marks","status":"publish","type":"page","link":"https:\/\/www.jamesandwells.com\/intl\/enforcing-rights-in-unregistered-trade-marks\/","title":{"rendered":"Enforcing rights in unregistered trade marks"},"content":{"rendered":"<h6>The owner of an unregistered trade mark may bring legal action against a competitor using that mark under the common law action of passing off or under the Fair Trading Act.<\/h6>\n<p>In both cases, to\u00a0enforce rights in an unregistered trade mark\u00a0the owner must prove to the satisfaction of the Court that:<\/p>\n<ul>\n<li>It has reputation in the disputed mark in the particular geographic locality in which the breach of rights occurred;<\/li>\n<li>This reputation applies to the particular type of goods or services in which the alleged breach of rights occurred;<\/li>\n<li>The unauthorised use of the unregistered trade mark will (or is likely to) cause confusion amongst its customers;<\/li>\n<li>That confusion will cause actual loss to its business or a strong likelihood of same; and<\/li>\n<li>The other party has no legitimate right of its own to use the disputed mark.<\/li>\n<\/ul>\n<p>Compared to an action for\u00a0breach of a registered trade mark\u00a0these Court proceedings can be costly and uncertain, as they are often reliant on the Court\u2019s interpretation of the evidence.<\/p>\n<p>Enforcing the rights conferred by a registered trade mark is simpler, more certain and often less expensive to achieve.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The owner of an unregistered trade mark may bring legal action against a competitor using that mark under the common law action of passing off or under the Fair Trading Act.
