{"id":3875,"date":"2022-02-24T15:10:51","date_gmt":"2022-02-24T02:10:51","guid":{"rendered":"https:\/\/www.jamesandwells.com\/guide-to-trade-mark-use\/"},"modified":"2022-02-28T17:10:47","modified_gmt":"2022-02-28T04:10:47","slug":"guide-to-trade-mark-use","status":"publish","type":"page","link":"https:\/\/www.jamesandwells.com\/intl\/guide-to-trade-mark-use\/","title":{"rendered":"Guide to trade mark use"},"content":{"rendered":"<h6>Your trade mark rights can be eroded, and eventually lost, if you are not careful with how you use your trade mark.<\/h6>\n<p>For instance, kerosene, linoleum, kiwifruit and corn flakes all originated as trade marks but became descriptive and now everybody is free to use them.<\/p>\n<p>Below is a brief guide to help you use your trade mark properly.<\/p>\n<h6>Identify your brand as a trade mark<\/h6>\n<h6>DO:<\/h6>\n<ul>\n<li>Quotation marks: e.g. \u201cNIKE\u201d<\/li>\n<li>Capital letters: e.g. HOLDEN<\/li>\n<li>Letters of a different colour, larger size or different style from those of the surrounding words: e.g. Coca-Cola<\/li>\n<li>The appropriate symbols, such as:\n<ul>\n<li>JANDALS\u00ae footwear<\/li>\n<li>VASELINE\u00ae petroleum jelly<\/li>\n<li>XEROX\u2122 photocopiers<\/li>\n<\/ul>\n<\/li>\n<li>An asterisk referring to a footnote stating that the word is a trade mark\/registered trade mark<\/li>\n<li>The word \u201cbrand\u201d to reduce the possibility that the trade mark will be thought of as the generic name for the product, such as: BAND-AID\u00ae brand adhesive bandages.<\/li>\n<\/ul>\n<h6>DO NOT:<\/h6>\n<ul>\n<li>Do not use your mark to describe the product or service, or as a generic term<\/li>\n<li>Examples of misuse of current registered trade marks include:\n<ul>\n<li>A great range of jandals on sale now<\/li>\n<li>Have a good time at the Fieldays<\/li>\n<li>Enjoy a cold radler this summer.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h6>Maintain the distinctiveness of your mark by never using it descriptively<\/h6>\n<h6>YOU CAN SAY:<\/h6>\n<p>Protect your car with ARMOUR ALL\u00ae protectant<br \/>\nThe doctor prescribed PANADOL\u00ae tablets<br \/>\nSTYROFOAM\u00ae plastic foam can be readily installed.<\/p>\n<h6>DO NOT SAY:<\/h6>\n<p>Armour all your car<br \/>\nThe doctor prescribed panadols<br \/>\nStyrofoam can be readily installed.<\/p>\n<h6>Other tips<\/h6>\n<h6>SYMBOLS<\/h6>\n<p>Before the trade mark is registered use the \u2122 symbol. This tells the world you are claiming trade mark rights in your mark and should be used if you export products to countries you may not have registered rights in.<\/p>\n<p>You can only use the symbol \u00ae if your mark is registered in that country.<\/p>\n<p>Do not use the symbol \u00ae on goods that may be exported to countries in which you do not have registered rights or for other variations of your mark.<\/p>\n<h6>USE OF YOUR MARK BY OTHERS<\/h6>\n<p>Be vigilant for, and advise us of any unauthorised use of your mark by others as this could lead to your mark becoming non-distinctive and vulnerable to attack. We can readily prevent unauthorised use.<\/p>\n<p>If you allow others to use your mark, you must carefully control how they may use the mark.
