The German multinational that owns Nivea has won rights to trademark \u2018Black & White\u2019.<\/h6>\n

Nivea is the only personal care brand in New Zealand that can now use the term \u2018Black & White\u2019 to sell its deodorants and anti-perspirants, after winning a five-year-long legal stoush against\u00a0its competitor.<\/p>\n

Nivea owner Beiersdorf\u00a0AG legally owns the trademark \u2018Black & White\u2019\u00a0beating out competitor Unilever, owner of Dove and Rexona, over the rights, a recent High Court judgment showed.<\/p>\n

The German company first applied to trademark\u00a0\u2018Black & White\u2019 in September 2014 but Unilever was quick to oppose it.<\/p>\n

The\u00a0Intellectual Property Office of New Zealand (IPONZ) allowed Unilever\u2019s\u00a0opposition on the basis that \u2018Black & White\u2019 was not a distinctive character, and the words describe\u00a0the characteristic or purpose of a product.<\/p>\n

James & Wells Solicitor Sebatien Aymeric commented on an article about the recent case in which\u00a0Nivea won the rights to exclusively use the term \u2018Black & White\u2019 to sell\u00a0\u00a0personal care products in New Zealand.<\/p>\n
