{"id":9179,"date":"2026-08-04T12:19:53","date_gmt":"2026-08-04T00:19:53","guid":{"rendered":"https:\/\/www.jamesandwells.com\/?p=9179"},"modified":"2026-08-04T12:19:53","modified_gmt":"2026-08-04T00:19:53","slug":"australian-battery-innovation-2026-patents-commercialisation","status":"publish","type":"post","link":"https:\/\/www.jamesandwells.com\/nz\/australian-battery-innovation-2026-patents-commercialisation\/","title":{"rendered":"Australian Battery Innovation in 2026: Patents, Commercialisation and Circular Economy Growth"},"content":{"rendered":"<h5>Post-2020 Australian patent filings: global interest and local participation<\/h5>\n<p>In June 2026, IP Australia released its <em>Australian <a href=\"https:\/\/www.ipaustralia.gov.au\/tools-resources\/ip-reports-and-data\/australian-ip-report-2026\">IP Report 2026<\/a><\/em>, a review of intellectual property activity and innovation trends across the Australian economy.<\/p>\n<p>Quite appropriately, battery innovation featured prominently in the <em>Australian IP Report 2026<\/em>, including analysis of battery circularity and critical minerals-related technologies. Against the backdrop of Australia&#8217;s importance as a supplier of minerals used in battery manufacture, the report provides insight into innovation and patenting activity occurring across different stages of the battery value chain.<\/p>\n<p>The June 2026 <em>IP Report<\/em> provides a contemporary analysis of innovation and patenting trends relevant to the battery sector in Australia. It is interesting to compare the observations in the 2026 report with those made in IP Australia&#8217;s earlier patent analytics study, <em>The Power of Innovation: A Patent Analytics Report on the Australian Battery Industry<\/em>, published in 2021. The earlier study analysed battery-related patent families involving Australian applicants or inventors with priority dates between 2001 and 2018, identifying a field characterised by strong research capability and substantial international collaboration. Over that 18-year period, rechargeable batteries accounted for more than 60% of patent families, while lithium-based technologies represented approximately one-third of all activity. Battery electrodes featured in more than half of battery-related patent families. CSIRO was the leading applicant by a significant margin, followed by Monash University, Redflow and the University of Wollongong.<\/p>\n<h5>Recent patent filings reveal a more commercial and globally engaged sector<\/h5>\n<p>In July 2026, we independently reviewed Australian patent applications and patents relating to battery technologies having priority dates from 1 January 2020 onwards. Our review identified 1,324 battery-related Australian patent filings. Only 67 filings, or approximately 5% of the total, involved an Australian applicant or co-applicant: the remaining 95% were filed by overseas-based applicants. While this review used a different methodology from the earlier IP Australia study, and therefore does not permit direct comparison, the result nevertheless provides a useful indication of Australia&#8217;s growing significance as a jurisdiction in which global battery companies seek patent protection. \u00a0The data suggest that Australia is increasingly viewed not merely as a source of battery innovation, but also as a market and strategic location warranting protection by international rights holders.<\/p>\n<p>In contrast to the time period 2001 to 2018, Australian patent applications filed since 2020 are not dominated by research institutions, instead arising from a more commercially diverse group of innovators. Between 2001 and 2018, CSIRO alone accounted for 35 battery-related patent families, making it by far the largest Australian participant. In contrast, only two post-2020 Australian filings were identified for CSIRO in our present review.\u00a0 The largest Australian filer was 3ME Technology Pty Ltd, with six identified filings. 3ME develops battery systems for mining, defence and industrial applications, reflecting Australia&#8217;s focus on battery deployment in heavy industry and off-grid environments. Resource Conservation and Recycling Corporation Pty Ltd, associated with Livium and its battery recycling operations, was responsible for four filings, highlighting the emergence of battery circularity and recycling technologies as a distinct area of innovation. Monash University also recorded four filings, including a collaboration with Deakin University, while Fortescue Future Industries and Gelion Technologies each featured prominently. Other repeat filers included the University of Queensland, the University of Adelaide, Anteo Energy Technologies, CSIRO, Current Design, University of New South Wales (via NewSouth Innovations), the University of Queensland and Wom-Batt Pty Ltd. Collectively, these applicants illustrate activity across a wide spectrum of technologies, including battery materials, recycling, battery manufacturing and battery-enabled industrial systems.\u00a0 The rise of companies such as 3ME Technology, Gelion, Livium and Fortescue Future Industries suggests that battery innovation is increasingly moving beyond the laboratory and into commercial development and industrial deployment.<\/p>\n<p>Another notable distinction concerns collaboration. The 2021 patent analytics report of IP Australia found that approximately one-third of battery-related patent families involving Australians were co-filed with collaborators, reflecting a highly networked innovation environment. By contrast, only 51 of the 1,324 recent Australian filings involved unrelated co-applicants, and only three of those involved an Australian entity as a co-applicant. While patent co-ownership is not the only measure of collaboration, the data suggest that recent Australian battery patenting activity has been driven predominantly by individual organisations rather than co-owned patent portfolios.<\/p>\n<p>Having drafted many of the CSIRO UltraBattery patent applications included within the 2001-2018 dataset, I have followed these developments with particular interest.<\/p>\n<h5>Circularity, industrial electrification and the next phase of battery innovation<\/h5>\n<p>Taken together, these observations point to a battery sector that is maturing and diversifying. Australia&#8217;s earlier strengths in lithium batteries, advanced electrodes and energy-storage systems remain evident, while newer themes such as battery recycling, circular economy technologies and industrial electrification are becoming prominent. At the same time, the substantial patenting activity by overseas applicants demonstrates that Australia remains on the radar of global battery companies. For firms and organisations developing battery chemistries, materials, recycling technologies, minerals-processing solutions or manufacturing innovations, the Australian patent landscape increasingly reflects an ecosystem that is both technologically active and commercially significant.
