At first glance, that approach appears rational.

Australia has a population approximately five times larger than New Zealand and received approximately five times as many patent applications in 2024. Yet sophisticated multinational businesses still filed almost 6,000 patent applications in New Zealand that same year. Yet those same statistics raise an interesting question. If New Zealand is merely a small peripheral market, why do sophisticated multinational businesses continue to file thousands of patent applications there every year? The answer may have less to do with population and more to do with strategy. For in-house counsel, IP leaders and portfolio managers, the real question is not whether New Zealand is as important as Australia.

The better question is:

What strategic value is surrendered when New Zealand is excluded from an Australasian patent portfolio?

In many cases, the answer may be more significant than commonly appreciated.

The Pharmaceutical Explanation Only Goes So Far

When discussing patent filings in smaller jurisdictions, pharmaceutical patents are often cited as the obvious explanation.

That rationale is understandable. A successful pharmaceutical product may justify patent protection in relatively small markets because revenues per customer can be substantial and regulatory exclusivity may dramatically increase the value of protection.

However, that explanation only goes so far.

Many of the technologies routinely protected in New Zealand have little to do with pharmaceutical pricing economics, including:

agricultural technologies;

dairy processing systems;

animal nutrition innovations;

mining technologies;

manufacturing systems;

food ingredients;

industrial equipment;

automation platforms; and

environmental technologies.

For many of these sectors, commercial returns are more closely linked to economic activity than population alone.

Yet New Zealand continues to attract thousands of patent applications each year, with the overwhelming majority originating from international applicants.2

If pharmaceuticals are only part of the explanation, what explains the continued filing activity by international businesses?

The answer may lie in what can be described as the New Zealand Patent Trifecta:

Commercial significance.

Additional rights.

A patent dispute test bed.

Patents Are More Than Market Protection

Patent filing decisions are often justified by reference to forecast revenue, market size, manufacturing footprint or potential infringement exposure.

These considerations remain important.

However, patents are not simply market-protection tools.

They are strategic assets that can create:

competitive advantage;

licensing opportunities;

commercial partnerships;

negotiation leverage; and

barriers to entry.

A New Zealand patent may also provide something less frequently discussed: an opportunity to test a patent before the stakes become significantly higher elsewhere.

An independent New Zealand proceeding can expose weaknesses in claims, technical evidence, inventor testimony and legal arguments, while also validating strengths that support licensing, investment and enforcement decisions.

Viewed through that lens, New Zealand begins to look less like a small market and more like a strategic asset.

The New Zealand Patent Trifecta

Commercial Significance Beyond Population

For certain industries, New Zealand’s importance exceeds what might be expected from population statistics alone.

The dairy sector provides perhaps the clearest example.

Fonterra, one of the world’s largest dairy exporters, has helped establish New Zealand as a globally significant centre for dairy production, food ingredients, agricultural innovation and animal nutrition. The country is frequently recognised for its importance in agriculture, food technology and dairy-related innovation.

The commercial interests of global participants such as Danone, Nestlé, animal health providers, feed suppliers and agricultural technology companies further reinforce the importance of innovation protection in New Zealand.

For technologies involving:

pasture management;

animal health;

feed optimisation;

food ingredients;

dairy processing;

agricultural analytics; and

nutritional products,

the relevant commercial ecosystem may be substantially larger than New Zealand consumers alone.

Population is therefore an imperfect measure of strategic importance.

Additional Rights Create Additional Leverage

A New Zealand patent is not simply a companion to an Australian patent.

It is a separate property right.

That means it creates:

a separate enforcement right;

a separate validity challenge;

separate remedies;

separate negotiation leverage; and

separate settlement dynamics.

A competitor seeking to clear a pathway across Australasia may need to address both Australian and New Zealand rights.

From a portfolio-management perspective, a more useful question may be:

Why surrender an entire jurisdictional asset when Australian protection has already been justified?

For many businesses, the incremental cost of obtaining New Zealand protection is relatively small compared with the strategic flexibility created by an additional enforceable right.

A Patent Dispute Test Bed

Perhaps the most underappreciated value of a New Zealand patent is information.

Patent disputes are rarely won or lost solely because of claim wording.

They often turn on:

expert credibility;

inventor testimony;

technical evidence;

experimental results;

documentary records; and

prior-art analysis.

The challenge for both patent owners and challengers is identifying strengths and weaknesses before committing significant resources to larger disputes.

This is where New Zealand may create disproportionate value relative to its size.

A High-Information Jurisdiction

Sophisticated organisations rarely assess jurisdictions solely by filing costs.

They also consider what information a jurisdiction may provide if a patent is challenged.

This becomes particularly important when managing commercially significant international patent portfolios.

A patent dispute generates information that cannot be replicated through patentability opinions, prior-art searches or internal portfolio reviews.

It forces experts, inventors and evidence to withstand scrutiny.

That process may expose:

weaknesses in expert evidence;

vulnerabilities in inventor testimony;

overlooked prior art;

evidential gaps; and

claim construction risks.

The obvious question becomes:

Where would you prefer to discover those weaknesses?

The Asymmetric Validity Advantage

Consider a business with both Australian and New Zealand patents.

Management may reasonably ask:

Where would we prefer to discover that our evidence is weaker than expected?

Or:

Where would we prefer to learn that our inventive-step position is vulnerable?

For many businesses, the answer may not be Australia.

A challenge in New Zealand may provide a meaningful assessment of the patent while limiting immediate commercial exposure to the New Zealand market.

The same logic may apply to challengers seeking to understand the strength of a patent before committing to larger disputes.

To be clear, a New Zealand decision does not determine validity elsewhere.

However, it may provide something almost as valuable:

Information that improves decision-making.

Conclusion

Australia may be the larger market.

Patent portfolio decisions, however, should not be made on population alone. For many international businesses, New Zealand is not simply an additional filing jurisdiction. It is an additional strategic asset. It may provide access to globally significant industries, an additional enforceable right and a patent dispute test bed capable of generating valuable information before disputes escalate into larger and more commercially significant markets. If a technology is important enough to justify protection in Australia, there should be a deliberate reason for excluding New Zealand. Why knowingly give up an additional patent right, an additional enforcement forum and an additional opportunity to test the strength of your patent portfolio?

If a technology is important enough to protect in Australia, what is the reason for leaving New Zealand unprotected?

Commercial Significance, Additional Rights and a Patent Dispute Test Bed in a Jurisdiction Five Times Smaller than Australia For many international businesses, New Zealand is often viewed as an optional extension of an Australian filing strategy.
